Will of John Bollard of Wheatley Booth - 1778


IN THE NAME OF GOD AMEN.


JOHN BOLLARD of Whitely Booth within the forest of Pendle and county of Lancaster Yeoman being infirm of body but of sound and perfect mind and memory do for the settling of my temporal estate and ------ make this this my last Will and Testament leave in it my interment to the discretion of my executor, herein after named and whereas I have some time ago surrendered into the hands of the Lords and Ladies of the said forest of Pendle according to their custom thereof all the messuage and tenament, one barn, one garden and the several closes, closures and parcels of land thereto belonging situate lying and being in Higham Booth within the said forest and now in the possession of DANIEL LAYCOCK as tenant or farmer thereof his assigns or undertenants of the yearly rent to the Lords and the Ladies of the said forest of Five Shillings and One Penny together with all ways, waters, watercourses, liberties, easements, profits, priviliges, hereditaments and appurtenances whatsoever to the said premises or any part thereof belonging or in any--- wise appertaining to the use and behalf of JOHN MAUD of Bank near Newchurch in the said forest Yeoman and his heirs to stand and be fined and seized of the said premises and every part thereof as trustee in trust to use for such uses intents limitations and provisions as I the said JOHN BOLLARD should declare and appoint in and by my last Will and Testament lawfully executed reference being had to the said surrender may and will appear.

Now it is my will and mind that the same JOHN MAUD my said trustee and his heirs shall stand fined and seized of and on all and singular the above said copyhold premises with the appurtenances to and for the only proper use and behalf of me the said John Bollard for and during the term of my natural life and from and after my decease then in trust to and for the only proper use and behalf of my brother HENRY BOLLARD his heirs and assigns forever and I do give and devise the same accordingly subject nevertheless to stand and be charged and chargeable with the payment of the sum of One Hundred Pounds of lawful money of Great Britain to my brother WILLIAM BOLLARD the same to be paid at the end of one calendar month next after my decease and in order to enable the said JOHN MAUD and his heirs to raise the same by mortgage of all or any part of the above said copyhold premises so surrendered in trust as aforesaid and also whereas I have some time ago surrendered into the hands of the Lords and Ladies of the said forest of Pendle according to the custom thereof all that the South end of one Messauge or Dwelling House as the same is now divided the South West end of one Barn and the several closes closures and parcels of land thereto belonging situate lying and being near Pendle Hill within Barley Booth in the said forest and now in the possession of JAMES STARKIE his assigns or undertenant and of the yearly rent to the Lords and Ladies of the said forest of Five shillings and Ten pence together with all rights members and appurtenances whatsoever tothe said last mentioned premises or any part thereof belonging to the use and behalf of JOHN MAUD aforesaid and his heirs to stand and be fined and seized of the last mentioned premises and every part thereof as trustee in trust to and for such uses intents limitations and purposes as I the said JOHN BOLLARD should declare and appoint in and by my last Will and Testament.

Now it is my will and mind that the said JOHN MAUD my said trustee and his heirs shall stand fined and seized of and in all and singular the last mentioned copyhold premises with the appurtenances to and for the only proper use and behalf of me the said JOHN BOLLARD for and during the term of my natural life and from and after my decease then in trust to and for the only proper use and behalf of my brother WILLIAM BOLLARD his heirs and assigns forever the said last mentioned premises are subject nevertheless to stand and be charged and chargeable with the payment of the sum of Two Hundred and Forty Pounds of lawful money of Great Britain to be equally divided amongst all the children born and to be born of my sister ELIZABETH now wife of CHRISTOPHER DODGESON of Paythorne in the county of York Yeoman share and share alike each share to be paid together with simple interest for the same after the sum of four Pounds Ten Shillings for the Hundred Pounds by the year and such interest is to be owed from the time of my decease and the amount of each lagacy is to be paid to the said children if more than one as follows, that is to say at his her or their respective age or ages of Twenty One years. I give and bequeath to my said brother WILLIAM BOLLARD Two Hundred and Forty Pounds of lawful money of Great Britain also I give and bequeath unto my said brother WILLIAM BOLLARD one large chest and my Bedstead and Bedding. And all the residue of my personal estate I give and bequeath to my two brothers WILLIAM BOLLARD and HENRY BOLLARD share and share alike. And lastly I do nominate and appoint my said brother WILLIAM BOLLARD executor of this my last Will and Testament hoping he will see the same carefully performed satisfying and confirming this sheet of writing paper and no other to be my LAST WILL AND TESTAMENT.

In Witness whereof I the said JOHN BOLLARD the Testator have to this my Last Will and Testament set my hand and seal this TENTH DAY OF MARCH IN THE YEAR OF OUR LORD ONE THOUSAND SEVEN HUNDRED AND SEVENTY EIGHT . JOHN BOLLARD.

Sealed signed and published by the said JOHN BOLLARD the testator as and for his Last Will and Testament in the sight and presence of us.
